Mr. Dewakar Sharma, learned Dy. AG submits that arrest of the petitioner in connection with the FIR no. 27/2023 has come to take place. It is further informed by Mr. Dewakar Sharma, learned Dy. AG that the arrest of the accused in FIR no. 25/2023 has also taken place.
Both the aforesaid FIRs bear allegations of commission of offence under section 376 Indian Penal Code. The present bail application was filed by the petitioner herein for seeking pre-arrest (anticipatory) bail.
On account of the arrest of the petitioner having taken place during pendency of this pre-arrest bail application, the present bail application is rendered infructuous.
Learned counsel for the petitioner is allowed to withdraw this bail application and the petitioner is at liberty to invoke appropriate legal course of action with respect to seeking regular bail.
Bail Application stands disposed of.
