The prayer made in the present petition is that the respondents be directed not to take possession of land bearing Khasra No. 84 measuring 2 Kanal 3 Marla situated at Shingni, Bhellsa for the construction of road without adopting due course of law.

Response stands filed by the respondent Nos. 1 to 3 in which it is stated that approved alignment of the road is strictly as per sanctioned DPR formulated in the year 2013 and the people of the area interpreting the same in different tones. It is further stated that the Land Acquisition process is under way with the Collector Land Acquisition (S.D.M) Gandoh. After the issuance of award, funds shall be demanded and deposited for making payment of compensation. It is also stated that road shall be constructed as per alignment and there is no intention to do it forcefully.

In view of the above, the present petition is disposed of with a direction to the respondents that in the event, land of the petitioner is to be consumed for the purpose of construction of the road, the same shall be done in accordance with law.
