Chander Kanta Vs U.O.I.Th.Chief of Army Staff and Ors.

The petitioner claims that she is entitled to receive rental compensation on account of the fact that her property was under acquisition by the BSF. Mr. Vishal Sharma, learned ASGI appearing on behalf of the BSF states that the amount of rental compensation is regularly deposited with the jurisdictional collector, who is otherwise supposed to release the same in favour of the eligible claimants.

It appears that some representations are also pending with the Collector, which are required to be decided as per the prayer made by the petitioner.

Be that as it may, this petition is disposed of with a direction to the respondent Nos. 4 to 6 to consider and decide the representations of the

petitioner with regard to her entitlement and if found genuine, the amount be released in favour of the eligible claimant.

Let an appropriate decision be taken within a period of two months from the date a copy of this order along with complete set of paper-book is made available to the respondents.
