For the last several hearings there is no representation on behalf of the petitioners.
On 21.5.2019, 08.7.2019. 03.9.2019, 23.9.2019 23.03.2021, nobody appeared on behalf of the petitioners. As a matter of fact, vide order dated 23.03.2021, notice was also issued to Mr. J. A. Kawoosa, appearing for the petitioner.
Today also when the is called out, nobody appeared.
This application is pending since May, 2017 and Trial before court below has been stayed. The stay of trial granted in 2017 has not been extended beyond the period of six months. Be that as it may, the stay of trial and the conduct of the petitioner has resulted in delay in conclusion of the trial before the court below.
This application is, accordingly, dismissed for non-prosecution. The Trial court shall proceed in the matter in accordance with law.
Let copy of this order be forwarded to the Trial court.
