Heard Mr Ramesh Arora, learned counsel seeking interim bail for the undertrial, who is allegedly involved in case FIR No. 69/2019 for commission of offences under section 8/20/29 NDPS.

Interim bail is sought on medical grounds qua the accused suffering from acute liver ailment.

The application is filed through father of the accused who has placed on record prescriptions and medical investigations.

Despite opportunities, respondents have not filed the objections.

Merits of the case cannot be discussed as the bail is not sought on the merits and the only ground on which bail is sought, is with reference to the ailment of the accused. The court is not inclined to make any observation or record any finding that otherwise will affect the merits of the case.

Keeping in view the prayer made in the application, it is thought proper to dispose of this application by directing the jail authorities concerned to get the accused medically examined and on medical examination, the accused

shall be provided necessary treatment without any lapse. The disposal of the bail application shall not come in the way of the accused to approach the trial court for seeking regular bail on merits.

Ordered accordingly.

Registrar (Judicial) Jammu, Wing of this Court, shall forward copy of this order to the concerned jail authorities.
