High Court of Himachal Pradesh, Shimla — RSA No. 68 of 2026 (Romesh Verma, Judge, oral; decision 19.06.2026). Regular second appeal by defendant Shyam Lal against plaintiff Raja Ram in a suit for recovery of Rs. 1,30,000/- with 12% per annum interest, founded on a loan allegedly advanced on 10.01.2015 vide agreement attested by the Notary Public and executed before witnesses Ram Bahadur and Joginder Singh, with an agreed fallback that the defendant would execute a sale deed of his share of land on failure to repay. The trial Court (Senior Civil Judge, Court No.1, Paonta Sahib) decreed the suit on 04.06.2024 with interest from the date of institution of the suit till realization; the defendant's appeal under Section 96 CPC was dismissed by the Additional District Judge, Paonta Sahib on 13.02.2026, affirming the trial findings. Deciding the appeal, with the parties' consent, on a single substantial question of law — whether the judgments and decrees of the courts below were erroneous owing to mis-interpretation, misconstruction and mis-appreciation of oral and documentary evidence, notably the trial Court's failure to discuss the oral evidence — the Court found that although the plaintiff examined four witnesses and the defendant himself entered the witness box, the trial Court had not bothered to discuss the oral evidence led by the respective parties, making the trial judgment and decree dated 04.06.2024 unsustainable. Without touching the merits, on this sole ground, the judgments and decrees of both courts below were set aside and the parties relegated to the Senior Civil Judge, Court No.1, Paonta Sahib, reviving Civil Suit No. 242/1 of 2015, with directions to proceed on the evidence already adduced, expedite disposal (the suit pertaining to 2015), counsel to appear on 25.06.2026 and seek no unnecessary adjournments.
