By way of the present application, a prayer has been made to condone the delay. As per the application, there is delay of 397 days in filing the main appeal. The said delay has been sought to be condoned on account of administrative exigencies, as mentioned in the application. The application is supported by the affidavit of Project Director NHAI.
Despite service of notice, the respondent has not bothered to put appearance and to controvert the contentions, as mentioned in the application. As such, the application under consideration is allowed and the delay, as occurred, in filing the main appeal, is ordered to be condoned.
