By way of this petition, the petitioner has inter alia prayed for the following reliefs:-

“(i). Issue an appropriate writ, order or direction for quashing and setting aside the impugned tentative seniority list dated 15.10.2024 issued by the respondents, to the extent the same adversely affects the rights and seniority of the petitioner;

ii. Issue an appropriate writ, order or direction directing the respondents to redraw/recast the seniority list of Assistant Professors (College Cadre) appointed during 2009-2014 by taking into consideration the actual date of joining, continuous length of service and date of regularization, strictly in accordance with law;

iii. Issue an appropriate writ, order or direction restraining the respondents from finalizing the impugned tentative seniority list dated 15.10.2024 till the objections/representations of the petitioner are duly considered and decided in accordance with law;

iv. That to direct the respondents to grant all consequential service benefits to the petitioner including proper fixation of seniority.”

This Court is of the considered view that the

present writ petition is premature. The petitioner has assailed the tentative seniority list by way of this petition and further prayer is that the respondents be restrained from issuing the final seniority list till his objections filed against the same are decided.

It is settled law that when a tentative seniority list is issued by a Department, objections are invited from all concerned and if any objections are received, the Department is duty bound to decide said objections before issuing a final seniority list. It is not the case of the petitioner that a final seniority list has been issued without deciding his objections. Cause of action will accrue once final seniority list is issued and the petitioner is aggrieved therewith. Therefore, at this stage, this petition is dismissed, being premature. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
