Learned counsel for the petitioner submits that since the learned District Judge, Solan, H.P. has entertained the appeal preferred by the petitioner and the delay in filing the appeal has been condoned and further the judgment and decree passed by the learned trial Court has been stayed, the present petition has been rendered infructuous and as such he does not want to press the same.

In view of the submission made by learned counsel for the petitioner, the petition is dismissed as not pressed. Pending application(s), if any, shall also stand disposed of.
