The instant application has been filed for release of

the awarded amount of compensation in a decided matter. It has been contended in the application that since the appeal has been finally decided, the applicant-respondent No.1 requires the amount of compensation for his day-to-day expenses.

It is contended by learned Additional Advocate General for the non-applicants that the matter is pending before the Government, but admittedly, as of today, no appeal has been preferred before the Hon’ble Supreme Court and final call has to be taken by the Government whether an appeal is required to be filed or not.

It is contended by learned counsel for the applicant that as per the award as passed by the learned Reference Court, the respondent No.1 has been held entitled to get the amount of compensation exclusively.

In view of the averments as made in the application which is duly supported by an affidavit, the entire balance amount as lying deposited in the registry of this Court along with up-to-date interest, is ordered to be released in favour of the applicant/respondent No.1 by remitting the same in his saving bank

account, the details whereof have been given in para-4 of the application.

The remittance of said amount shall be subject to filing of an affidavit by the applicant/respondent No.1 within a period of two weeks from today before the learned Registrar (Judicial) to the effect that in case any appeal is preferred by the non-applicants before the Hon’ble Apex Court and in the event of the same being allowed, in that event, the applicant shall be liable to refund the entire amount along with up-to-date interest.
