The instant application has been filed for release of

the awarded amount of compensation in a decided matter. It has been contended in the application that since the appeal has been finally decided, the applicants-respondents require the amount of compensation for their day-to-day expenses.

It is contended by learned Additional Advocate General for the non-applicants that the matter is pending before the Government, but admittedly, as of today, no appeal has been preferred before the Hon’ble Supreme Court and final call has to be taken by the Government whether an appeal is required to be filed or not.

In view of the averments as made in the application which is duly supported by affidavits, the entire balance amount as lying deposited in the registry of this Court along with up-to-date interest, is ordered to be released in favour of the applicants in equal shares by remitting the same in their saving bank accounts, the details whereof have been given in para-4 of the application.

The remittance of said amount shall be subject to filing of affidavit(s) by the applicants within a period of two weeks from today before the learned Registrar (Judicial) to the effect that

in case any appeal is preferred by the non-applicants before the Hon’ble Apex Court and in the event of the same being allowed, in that event, the applicants shall be liable to refund the entire amount along with up-to-date interest. The application stands disposed of.
