The present petition under Section 29-A (4) of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking extension of time for passing of the award by the learned Arbitral Tribunal.

2 Learned counsel for the petitioner has referred to Annexure A-5 order dated 14.12.2025, whereby the learned Arbitrator has ordered as follows:-

“This case file was for final order today, but the order could not be ready due to two reasons. Ist reason is that I am having eye ailment for the last one month for which I

am getting treatment from Chandigarh. I have been advised by the Doctor not to stress my eyes much for the next 2/3 months. If I keep on going through any material i.e. files or books then there is some irritation in my eyes. Secondly, the claimant as well as the respondent were directed to file calculation sheet of 10C claim and GST model calculation regarding claim Nos. 10 and 7, respectively vide order dated 26.04.2025. These sheets have been filed by the respondent, but the claimant has filed the calculation sheet of 10C claim only and has not filed the model calculation regarding payment of GST. He is, therefore, required to file model GST calculation. Due to these two reasons the award could not be finalized. The time period for passing the award is going to expire today and, therefore, the parties are advised to file petition before the Hon'ble High Court of H.P. for extension of time as required under Section 29A (4), of The Arbitration and Conciliation Act, 1996. As and when the time is extended then the file shall be taken up accordingly. Copies of the order have been supplied to both the parties today itself.”
