Director of Elementary Education, Mandi, whereby the petitioner's case — considered pursuant to the directions of the judgment sought to be executed — was rejected on the ground that the petitioner does not possess the requisite qualification as per the R&P Rules for the post of Language Teacher. Holding that the earlier judgment contained only a direction to consider the petitioner's case, which consideration had been undertaken and had culminated in rejection under the R&P Rules occupying the field, the Court held that nothing remained to be adjudicated in the execution petition and disposed of the same, reserving liberty to the petitioner to assail the purported-compliance order before the appropriate Court in appropriate proceedings.

While placing on record communication dated 25.09.2025, issued under the signatures of Director, School Education, Himachal Pradesh, enclosing therewith copy of office order dated 1^st July, 2025, issued by the Dy. Director of Elementary Education, Mandi, District Mandi, Himachal Pradesh, Mr. Vishal Panwar, learned Additional Advocate General, states that respondents, after having considered the case of the petitioner in light of the directions contained in the judgment, sought to be executed, have rejected the same on the ground that petitioner does not possess the requisite qualification as per R&P Rules for the post of Language Teacher .

Having carefully perused aforesaid documents, which are taken on record vis-à-vis mandate contained in the judgment, there appears to be merit in the contention of learned Additional Advocate General. Since there was only direction to consider the case of the petitioner and respondents, after having considered the case of the petitioner in light of R&P Rules occupying the fields, have rejected the case of the petitioner, nothing remains to be adjudicated in the instant petition and accordingly same is disposed of. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to the order passed in purported compliance of the judgment sought to be executed.
