By way of instant petition, petitioner has prayed for

following reliefs:

“i) That this Hon’ble Court may be pleased to issue the Writ in the nature of Certiorari or any other appropriate writ order or directing quashing and setting aside the impugned order dated 27.02.2023 (P-5), whereby the case of the Petitioner has been rejected in an illegal and arbitrary manner, being patently illegal, arbitrary and unconstitutional besides the same being in violation to the settled law of the land.

ii) That this Hon’ble Court may be pleased to issue the Writ in the nature of mandamus directing the Respondents to accept the request of the Petitioner for refixation of pay with 15% factor in terms of Notification dated 10.02.2022 and his arrears be calculate accordingly

and the Respondents be further directed to release the arrears of the Petitioner.”

Learned counsel for the parties are ad idem that case of the petitioner is squarely covered by the judgment dated 24.04.2025 passed by Coordinate Bench of this Court in CWP No.1558 of 2024, titled Satish Kumar Vs. State of H.P. and Others .

Having perused the averments contained in the petition, especially relief clause, vis-à-vis judgment dated 24.04.2025 passed by Coordinate Bench of this Court in Satish Kumar case (supra), this Court finds that case of the petitioner is identical to the aforesaid case decided by Coordinate Bench of this Court. Vide aforesaid judgment, this Court has already dealt with all the points raised in the instant petition and as such, respondents can be directed to decide the case of the petitioner in light of the aforesaid judgment rendered by this Court.

Consequently, In view of the above, the directions contained in the aforesaid judgment rendered by Coordinate Bench of this Court in Satish Kumar case (supra) are ordered to be made mutatis mutandis applicable in the present case for all intents and purposes. In the aforesaid terms, present petition is disposed of along with pending application(s), if any
