CMP (M) 2046 of 2024 has been filed for condoning the delay of 86 days in filing the appeal challenging the judgment passed by the learned Single Judge on 22.05.2024 in CWP No. 7388 of 2023, titled as Ramesh Kumar & others Vs.

The applications are duly supported by the affidavits. Though, the reply has been filed in Ramesh Kumar’s case ( supra), as such contesting the application, but keeping in view the settled principles of law laid down in Collector, Land Acquisition, Anantnag Vs. Smt. Katiji and others, (1987) 2 SCC 107 that each and every day’s delay is not to be explained, we are of the considered opinion that both the applications are liable to be allowed as sufficient cause has been made out. Accordingly, the applications are allowed and delay in filing the appeals is condoned.

Appeals be registered.

Issue notice. Mr. Ganesh Barowalia, and Mr. Servedaman Rathore, Advocates, waive service of notice for the respective respondents in the respective appeals.
