Since the matter has been compromised, as such,

the applications are allowed and the main appeals are taken up for consideration today itself.

Vide order of the even date, passed in CMP

Nos.20241 of 2024 in RSA No.206 of 2019 and CMP No.20242 of 2019 in RSA No.207 of 2019, the appellants have placed on record the Compromise Deed, dated 02.10.2024.

The appeal bearing RSA No.206 of 2019 has been filed by the appellants against the judgment and decree dated 29.03.2019 passed by the learned District Judge, Solan, H.P., (hereinafter to be referred as the First Appellate Court), in Civil Appeal No.42-S/13 of 2017, titled as Ravinder Singh Verma & another versus Chander Shekhar Sood & others.

RSA bearing No.207 of 2019 has been filed by the appellants against the judgment and decree dated 29.03.2019, passed by the learned District Judge, Solan, H.P., in Civil Appeal No.41-S/13 of 2017, titled as Ravinder Singh Verma & another versus Chander Shekhar Sood & others.

Vide the common judgment and decree dated 29.03.2019, the learned First Appellate Court has dismissed both the appeals.

Those appeals, filed before the learned First Appellate Court, had been preferred against the judgment and decree dated 28.08.2017, passed by the learned Civil Judge, (Junior Division) Kandaghat, Camp at Solan, District Solan, H.P., (hereinafter referred to ‘as the trial Court’), in Civil Suit No.46-S/1 of 2007/03, as well as, Counter Claim No.2-S/1 of 2013, titled as Raghubir Sood through his legal representatives versus Ravinder Singh Verma and another.

In terms of the said judgment and decree, the learned trial Court has decreed the suit filed by the predecessor in interest of the respondents and dismissed the counter claim filed by the appellants.

Today, the joint statement of Shri Somesh Sharma, learned counsel for the appellants and Shri N.K. Bhalla, learned counsel for the respondents, has been recorded.

According to the said statement, the matter has been settled between the parties vide compromise deed, Ext. PA.

In view of the said compromise, the learned counsel for the parties have prayed that the judgment and decree, passed by the learned trial Court, which has been affirmed by the learned First Appellate Court, may be quashed and set-aside. They have also prayed that the joint statement of the parties, which had already been recorded on 07.10.2024 by the Assistant Collector (First Grade) Solan, District Solan, H.P.(Ext. PB), may be read as part and parcel of the decree.

In view of above, considering the fact that the matter has been compromised between the parties, the judgment and decree, passed by the learned trial Court, as affirmed by the learned First Appellate Court, is ordered to be set-aside. The suit and the counter claim are disposed of in terms of the compromise deed Ext. PA. The parties shall be bound by the terms and conditions of the compromise deed Ext.PA.

The compromise deed Ext. PA and the statements of the parties recorded by the Assistant Collector (First Grade) Solan, Ext. PB, shall form part of the decree.

Decree sheet be prepared accordingly.

The pending application(s), if any, are also disposed of.
