Leaving everything aside, reply filed on behalf of respondent No.4 under the signatures of Principal, Vallabh Government College, Mandi, Himachal Pradesh, clearly reveals that there is no fault, if any, on the part of the petitioner, rather, inadvertently, a wrong assessment qua the petitioner was uploaded on web portal of the University by the College, which after realizing its mistake, repeatedly requested respondent-University to correct the mistake, however, under the garb of Notification dated 18.06.2021, which is otherwise not applicable in the present case, respondent No.3 repeatedly attempted to defeat the claim of the petitioner. No doubt, respondent No.4/College should have been careful while uploading the internal assessment of the petitioner, but certainly negligence, if any, on the part of respondent No.4 cannot be a ground to reject the claim of the petitioner, who otherwise had no role, if any, in uploading the marks, rather, on account of uploading of wrong marks, he has been continuously suffering for no fault on his part.
