This writ petition has been filed by the petitioners, minor at the time of filing of the writ petition through their father and natural guardian Sh. Surender Parkash. During pendency of the petition, petitioner No.1 attained the age of majority and was accordingly permitted to pursue the case in his independent capacity.

2. The petitioners seek direction to the respondents to enter their name in the Panchayat Register and Pariwar Register. They are admittedly the children from second marriage of Sh. Surender Parkash with Smt. Usha Devi (mother of the petitioners).

3. The respondents have declined the reliefs prayed for by the petitioners on the ground that Sh. Surender Parkash had solemnized second marriage with Smt. Usha Devi. Respondent No.1 in its reply filed to the writ petition has simply stated that contents of the writ petition pertain to the Panchayati Raj Department and it is not concerned with the reliefs prayed for by the petitioner. Respondents No.2 & 4 have adopted the reply filed by respondent No.1. No reply to the writ petition has been filed by respondent No.3-the concerned Gram Panchayat.

4. The controversy involved in this case has already been decided in Navya & Ors. Vs State of H.P. & Ors.² in favour of the petitioners.

Hence, for the reasons alike, this writ petition is also allowed. Respondents are directed to enter the names of the petitioners in the Panchayat Register and Pariwar Register of the concerned Gram Panchayat within five weeks from today.

With above direction, the instant petition is disposed of.

Pending miscellaneous application(s), if any, shall also stand disposed of.
