Pradhan/Secretary, Gram Panchayat, Barnoh, vide letter dated 26.08.2020 (Annexure R-III) to initiate proceedings under Section 12 of the Himachal Pradesh Panchayati Raj Act, 1994, to remove the encroachment from the suit land, as the same is in the ownership of the Gram Panchayat, Barnoh. Pursuant to afore directions, Gram Panchayat, Barnoh, District Una, Himachal Pradesh, passed a resolution No.17, thereby making request to appropriate authority for demarcation of suit land. It is averred in the reply that as soon as demarcation report is received from the competent authority, appropriate action in accordance with law shall be taken against the encroacher. 4. Though report submitted by Patwari, placed on record by the petitioner as Annexure P-2, suggest that encroachment, if any, made by respondent No.6 on the Government land stands removed, but otherwise also having taken note of the fact that proceedings have already been initiated against respondent No.6 by respondent-Gram Panchayat, there appears to be no justification for this Court to keep the present petition alive, rather, same can be disposed of with the direction to respondent No.4 to ensure that appropriate action in accordance with law is taken against encroacher i.e. respondent No.6, if not already taken, expeditiously, preferably, within a period of two months. Ordered accordingly.
