This petition coming on for orders this day, the court passed the following:

By way of instant petition filed under Art. 215 of the Constitution of India read with Ss.. 11 & 12 of the Contempt of Courts Act, 1971 prayer has been made initiation of contempt proceedings against the respondent for willful disobedience of order dated 11.1.2022 passed by this Court in

CWP No. 327 of 2022, titled Sunil Paul v. Union of India and others, whereby respondent herein was directed to decide the pending appeal of the petitioner within a period of two months. Since the respondent has failed to comply with the direction contained in the order (supra), petitioner has approached this Court in the instant proceedings, for initiation of contempt proceedings against the respondent.

Mr. Balram Sharma, learned Assistant Solicitor General of India, while accepting notice on behalf of the respondent, states that though he has reasons to believe that the order in question stands complied with, but if not, same would be complied with, within a period of two weeks.

Consequently, in view of the fair stand taken by learned Assistant Solicitor General of India, this Court sees no reason to keep the present proceedings alive and same are disposed of with a direction to the respondent to do the needful in terms of order (supra), within two weeks, failing which petitioner would be at liberty to get the present petition revived, so that appropriate action is taken against the contemnor.
