Despite granting opportunity, no reply has been filed till date.
For the reasons stated in the application, duly supported by an affidavit, it appears that the delay of 96 days, which has crept-in in filing the leave to appeal alongwith appeal, was neither willful nor intentional, but, for the reasons stated in para 2 of the application and there is sufficient cause which prevented the applicant-appellant from filing the leave to appeal alongwith appeal within prescribed period of limitation. Therefore, delay is condoned. The application is disposed of accordingly.
