The present application is maintained by the applicants under Section 151 of the Code of Civil Procedure, for releasing the amount of compensation lying deposited before this Court. As per the applicants, the matter was compromised and decided by this Court and the impugned award passed by the learned Tribunal below for a sum of `2,52,000/- alongwith 9% interest per annum from the date of claim petition was upheld. As per the award, the widow of deceased, respondent/claimant No.1, was held entitled for 60% of the awarded amount and the remaining 40% was to be divided equally amongst respondents/claimants No.2 to 5. On 14.10.2004, the awarded amount of the share of respondent No.1, Kumari Devi, widow of deceased, was released to her with up-to-date interest. The amount of the share of respondent No.2, Geeta Devi daughter of Man Bahadur, was also released to her with up-to-date interest. The balance amount of the share of respondents/claimants No.3 to 5, is still lying deposited before this Court. As per the applicants, the deceased was a migrant labourer from Nepal and after his death his wife and children had migrated back to their native country and visited India occasionally.
