The present application is maintained by the applicant under Section 5 of the Limitation Act, for condonation of delay in filing the appeal. As per the applicant, the impugned award was announced by the learned Tribunal below, on 19.4.2016 and the certified copy of the said award was applied on 20.4.2016 in Copying Agency. The certified copy of the impugned award, was attested on 25.4.2016 and the same was delivered to the learned counsel before the learned Tribunal below on 25.5.2016. On 2.8.2016, after having obtained information to assail the impugned award in the present matter, the entire case file of the present case alongwith all necessary records etc. was sent to the office of learned counsel for the applicant and the same was delivered in the office of the counsel for the applicant on 9.8.2016. On 11.8.2016, the appeal was drafted. Since the appeal is also to be accompanied with the statutory amount deposit, the process for preparing the demand draft, has also been started in the meantime and on 12.8.2016, the same was arranged and prepared. On 22.8.2016, special messenger was sent alongwith the demand draft from Panchkula to Shimla, at the office of the learned counsel for the appellant and for signing of the appeal. The application is duly supported with an affidavit. No reply to the application has been filed nor intended to be filed.
