By way of present miscellaneous application, the applicant/appellant has prayed for condonation of delay in filing the appeal, on which notices were issued by this Court on 07.01.2016. As per report of the Registry, notices stand duly served, however, no one has put in appearance on behalf of the non-applicant/respondent. Accordingly, the said nonapplicant/respondent is proceeded against ex parte as far as adjudication of the present miscellaneous application is concerned. In view of the averments made in the present application, which are duly supported by an affidavit filed by the Divisional Manager H.P. State Forest Division Corporation Ltd. Saraswati Nager (Sawra), H.P., the same is allowed and delay of 53 days in filing the present appeal is condoned. Registry is directed to register the appeal. Application stands disposed of.
