The learned Additional Advocate General has submitted that the case
was registered against the petitioner as he uttered some objectionable remarks regarding the caste of the complainant. The petitioner is present in the Court, who has been identified by his counsel. Interim bail was granted to the petitioner on 4.12.2009 on which date he surrendered in the Court. The learned Additional Advocate General has submitted that the petitioner has joined the investigation and no recovery is to be made from the petitioner. The investigation in the case is complete. In the facts and circumstances of the case, the petitioner is ordered to be released on bail in FIR No. 314 of 2009 dated 25.11.2009 registered at Police Station, Kangra, under Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 323 IPC, subject to his furnishing personal bond in the sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of Deputy Registrar (Judicial) of this Court today itself. The petitioner shall not hamper the investigation and tamper with the prosecution evidence in any manner. In case the petitioner fails to furnish necessary bail bonds as directed, then he shall be taken into custody.
