By way of captioned petition, the petitioner states that the petitioner is the father of respondent no. 5 – Bharti – the corpus. It is stated that the corpus is minor and she eloped with respondent no. 4. Accordingly, the petitioner has filed a complaint before Katwara Police Station, Dahod Since no action and efforts were taken by the police authority to search the corpus, the petitioner gave an application dated 29.07.2025 to respondent no. 2 to take action on the FIR and to bring the corpus back from the custody of respondent no. 4. Since 11 months have passed thereafter, and no action is taken by the authority, the petitioner has filed present petition stating that corpus has been unlawfully confined and detained by private respondents.

Today, the corpus has been brought before this Court by the P.I., Katwara Police Station. We made the inquiry and upon inquiry of corpus, she expressed her willingness not to join her parents and expressed her desire to reside with Nari Savrakshan Gruh. She has also stated that she was not unlawfully confined and detained.

Having regard to the peculiar facts and circumstances of the present case as referred above, we are of the view that, the corpus is major and the corpus is not detained illegally and wrongfully confined by respondents against her will and wish. As per wish of the corpus, the police authority is directed to send the Corpus at Nari Savrakshan Gruh, Nizampura, Nr. Gelani Petrol Pump, Nr. Ranchhodji Ni Vadi, Vadodara.

Accordingly, petition is rejected. Notice discharged. The P.I., Katvara Police Station is directed to do the needful and see to it that the corpus will reach to the Nari Savrakshan Gruh, Nizampura, Nr. Gelani Petrol Pump, Nr. Ranchhodji Ni Vadi, Vadodara.
