1. Heard learned advocate Mr Rushang D Mehta for the Plaintiff and learned advocate Mr Harsh N. Parekh for the Defendant.

2. Learned Advocate Mr Rushang D Mehta for the Plaintiff and Mr Harsh N Parekh for the Defendant have tendered a Joint Purshish dated 10^th September 2026. As per the Joint Purshish dated 10^th September 2026, the parties entered into discussion for :-

a. Defendants securing the Plaintiffs’ alleged claim in the captioned admiralty suit by way of a Club Letter of Undertaking.

b. The Plaintiff’s confirming that upon the receipt of a scanned non-negotiable Club Letter of Undertaking in the agreed format, the Plaintiffs will withdraw the captioned admiralty suit and vacate the order of arrest dated 27^th July

2026 in favour of the dispute resolution clause of the Charterparty.

c. The Defendants, either through their lawyers or directly through their Club, will send the original Club Letter of Undertaking within 2 weeks of vacating the order of arrest dated 27^th July 2026 to the English Solicitors of the Plaintiff, HFW at their office in London.

3. The parties agreed on the above terms and in furtherance of the same, the Defendant has provided the Plaintiff with a scanned copy of the Club Letter of Undertaking.

4. As the Plaintiff has received the scanned copy of the Club Letter of Undertaking, it now wishes to withdraw the captioned admiralty suit and vacate the order of arrest dated 27^th July 2026 in terms of the agreed terms and the Joint Purshish dated 10^th September 2026. The Joint Purshish dated 27^th July 2026 is ordered to be taken on record.

5. In view of the Joint Purshish filed, the suit is disposed of, as withdrawn. The order dated 27^th July 2026 stands vacated, and the Defendant Vessel is hereby ordered to be released forthwith. The Registry is directed to issue a release warrant forthwith.

6. The Registry is further directed to refund permissible Court fees in the name of the learned advocate for the plaintiff.

7. The Registry is directed to send this order to the Port and Customs Authorities at Deendayal Port, and the authorities shall act on an email copy of the order and release the Defendant Vessel

8. The Port and Customs Authorities at Kandla are directed to act on an email message enclosing a scanned copy of the Warrant of Release and this Order.

9. It shall be open for the advocates of the Defendant Vessel to directly serve the Port and Customs Authorities at the Kandla Port with a copy of this Order and the Warrant of Release; and the Port and Customs Authorities at the Kandla Port are directed to act on a simple copy of the Order.

10. It is also open for the plaintiff's or defendant's advocate to communicate the above order by email at their own cost, and the Port and Customs authorities are directed to act on the email message with an ordinary copy of this order.

Direct Service is permitted today.
