Jani for the petitioner, learned Assistant Government Pleader Mr.Dhawan Jayswal for the respondent Nos.1 to 3 and learned Senior Advocate Mr.B.S.Patel for learned advocate Mr.Chirag G. Patel for the respondent Nos.4 and 5.

1.1. Learned Assistant Government Pleader Mr.Jayswal, under instructions from Mr.Bharat Joshi, Director, Sugar, Gandhinagar, has made a statement at bar that the respondent No.2 shall withdraw the impugned order dated 27^th October, 2020 and shall pass a fresh de-novo order after giving an opportunity of hearing to all the concerned parties within a period of three months

from today adjudicating the show-cause notice dated 14.07.2020 in accordance with law.

1.2. Learned Assistant Government Pleader Mr.Jayswal further submitted that the respondent No.2 shall permit all the concerned parties to raise all contentions available under the law to pass a fresh order.

In view of the above statements, grievance raised in this petition would not survive at this stage.

Without entering into merits of the matter, the petition is disposed of. Notice is discharged.
