The allegations are to the extent that the accused escaped from jail confinement and the allegations against the coaccused is of assisting the main accused in escaping from judicial custody. It is further stated that as per the prosecution, the co-accused, Bharat Zaveebhai Ramani had brought some juice spiked with some intoxicant and which was consumed by the police who were keeping a watch on Nikunj Donga at G.K. General Hospital and from there, Nikunj Donga and others escaped police custody. The present applicant is alleged to be the Driver of the Car in which Nikunj Donga and Bharat Ramani escaped. Thereafter, it alleged that all of them reached Bhuj and stayed at Ashish Hotel and on 26.03.2021, in a Hyundai I-20 Car No.GJ-03-EL-0517 have further traveled and as per the allegations, all the accused alongwith the present applicant were found at Nainital. It is submitted that the only role attributed to the present applicant is of driving the Car and most of the accused, i.e. Rameshbhai B. Gangal, Manganbhai K. Bharvad, Alimamad Osman Langa, Parth @ Lalo Dhanani Patel, Rajesh R. Rathod, Nikunj Donga, Vijay Sangani, Aakash Vinubhai Arya and Bharat Zaveebhai Ramani have been enlarged on bail. It was, therefore, prayed that the present application may be allowed and the applicant herein may be released on regular bail.
