1. By way of this petition, the present petitioner has prayed for the following reliefs;

“a. Your Lordships may be pleased to admit and allow this petition;

¶16

b. Your Lordships may be pleased to issue a writ of mandamus of writ in the nature of mandamus or any other appropriate writ, order or direction, directing to respondent No.1 to initiate legal action under the provisions of the Gujarat Panchayat Act, 1993 against the respondents No. 2 and 3, in the interest of justice;”

2. Heard learned advocate Mr.Amit Joshi for the petitioners through video conference.

3. Learned advocate Mr.Joshi submits that looking to the allegations of financial irregularities made against the respondents No. 2 and 3, some actions are required to be taken against them.

Learned advocate Mr. Joshi draws attention of this Court to the representation made by the petitioner to respondent No. 1 on 08.01.2021, which is annexed at annexure-A to this petition from page Nos. 14 to 16. According to learned advocate Mr.Joshi though the representation was made in the month of January,2021, till date no action has been taken on the aforesaid representation, and therefore, the petitioner has constrained to approach this Court by filing present petition.

Learned advocate Mr. Joshi has further submitted that if, appropriate directions are issued to respondents No.1 to consider the representation of the petitioner and to decide in accordance with law within some time bound schedule, his grievance would be largely redressed at this stage and in that case he would not press this petition at this stage.

In view of the above submission made by learned advocate Mr.Joshi, the respondent No.1 is directed to consider the representation made by the petitioner, which is annexed at Annexure-A to this petition as early as possible preferably within a period of four(04) months from the date of receipt of the order by passing reasoned order and the copy of the said be communicated to the petitioner through RPAD.

7. It is clarified that, while passing this order, this Court has not gone into the merits of the case.

8. In view of the aforesaid directions, learned advocate Mr.Joshi does not press this petition. Petition stands disposed of as not pressed. Direct service is permitted.
