By this petition, the petitioner prays for quashing and setting aside the order dated 08.01.2021 passed by the Geologist, Geology & Mining Department and also direction to the respondent to reactivate the ATR account of the petitioner.

Mr.Krutik Parikh, learned Assistant Government Pleader submitted that the grievance of the petitioner is against the communication dated 08.01.2021 so also the show cause notice dated 06.01.2021. It is submitted that let the petitioner approach the Office of the Collector, who in turn, shall decide and adjudicate the notice at the earliest.

Mr.Jaivik Uday Bhatt, learned advocate appearing for the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the Geologist, Office of the Geology & Mining Department so also the Office of the Collector.

In view of the aforesaid statements made by the learned advocates appearing for the respective parties, request of the

petitioner for withdrawal of the present writ petition is acceded to.

Pertinently, the show cause notice has been issued on 06.01.2021 requiring the petitioner to remain present on 28.01.2021. In the meantime, the petitioner addressed a communication dated 07.01.2021 which, led to the issuance of the communication dated 08.01.2021; however, the petition is essentially against the show cause notice and therefore, the petition is disposed of with a direction to the Office of the Collector and the Office of the Geologist to adjudicate the show cause notice dated 06.01.2021, after hearing the petitioner and strictly in accordance with law, within a period of twelve weeks from the date of the receipt of the copy of this order. The order shall be communicated to the petitioner within a period of one week thereafter.

It is clarified that this Court, has not examined the merits of the matter and the concerned authority shall decide and adjudicate the notice independently and without being influenced by the withdrawal of the present writ petition.
