1.Heard learned advocate Mr. Prabhav A.
Mehta for the petitioner and learned advocate Mr.
Anuj K. Trivedi for the respondents- Ahmedabad
Municipal Corporation through video conference.
2.Learned advocate Mr. Anuj K. Trivedi
draws attention of this Court to the affidavit-
in-reply filed by the respondents-Corporation and
more particularly, paragraph nos. 6.1 to 6.3 and
submits that in view of the aforesaid averments
made in the affidavit-in-reply, the petition
would not survive, as it has become infructuous.
3.Learned advocate Mr. Mehta submits that,
prima-facie, it seems that the petition has
become infructuous, in view of the affidavit-in-

reply filed by the respondent- Ahmedabad
Municipal Corporation, but since he is not in
touch with the petitioner, he is not in a
position to make any definite statement. However,
he says that, if, the petition is disposed of, on
the basis of the affidavit-in-reply, he does not
have any objection, but the liberty may be
reserved in favour of the petitioner, in case if,
something contrary to the affidavit-in-reply is
found by the petitioner.
4.In view of the aforesaid, considering
the fact that as per the affidavit-in-reply and
more particularly as per paragraphs nos. 6.1 to
6.3 of the affidavit-in-reply, the petition has
become infructuous. The same is disposed of, as
having become infructuous. The liberty is
reserved in favour of the petitioner, in case of
any difficulty.
5.The petition stands disposed of,
accordingly. Notice is discharged. No order as to
costs.
