Having heard the learned counsel, we are of the opinion that the present Letters Patent Appeal has become infructuous as merely academic question about the manner in which the interviews were held and the minimum marks were fixed for the present Selection Process of 2011 is no longer surviving because thereafter two selection process have taken place as stated by Mr. D.G.Shukla, learned counsel for the Gujarat Public Service Commission and there is no existing vacancy as notified in that Advertisement of 2011. Therefore, we are of the view that there is no need to examine the said academic point at this stage therefore leaving the question free and open to be decided in an appropriate matter, the present Letters Patent Appeal is disposed of as infructuous. No costs.
