With the consent of learned advocates for the respective parties, the matter is taken up for final disposal today.

This application is filed for modification of condition imposed by the learned Additional Sessions Judge, Viramgam vide order dated 10.03.2021 in Criminal Misc. Application No.74 of 2021, by which learned Sessions Judge refused to delete condition no.5, wherein, it was ordered that the applicant to deposit passport with the learned Trial Court.

Pursuant to order dated 07.11.2015, learned 4^th Additional Sessions Judge, Viramgam imposed condition to deposit passport while granting bail to the applicant for the offence punishable under sections 379, 511, 285, 427, 120(b) of IPC, under sections 3, 4 of Damage to Public Property Act, under section 23 of the Petroleum Act and under section 15(2) of Petroleum and Minerals Pipeline Act.

Having heard submissions made at bar and considering the impugned order, learned Sessions Judge has categorically

noticed that there is no any breach of condition at any point of time. It is reported that no any charge is framed and trial is pending.

Considering the facts and circumstances of the case and conduct of the applicant, condition no.5 imposed by the learned Trial Judge while granting bail to the applicant pursuant to the order dated 07.11.2015 is hereby deleted. Learned Trial Court shall return passport to the applicant, pending trial.

In view of above, present application stands disposed of.
