Leave to amend to place on record a communication dated 29.10.2018 by the petitioner to the Deputy Engineer, UGVCL- respondent no.2.

The prayer by the petitioner is for restraining the Electric Company from giving an electric connection on a property bearing land survey nos. 100/4 and 107/1, which according to the petitioner was originally owned by the respondents no.3 to 5, however was purchased by the petitioner by a registered sale deed way back in the year 1990.

It is also his case that the original owners have encroached into the said property and have now received all the basic amenities like electric connection and water connection. The respondents, not being lawful owner and occupier of the premises, are not required to be given electric connection.

The issue raised by the petitioner involves disputed questions of fact and in connection with the same, sofar as the revenue proceedings are concerned, petitions being Special Civil Application no.11156 of 2018 and Special Civil Application no. 11028 of 2018 are filed and the same are pending before this Court. The Court need not enter into the disputed questions of fact. However, it is directed that the representation made by the petitioner dated 29.10.2018 to the respondent no.2 be decided expeditiously.

A Cost of Rs.500/- shall be deposited with the registry of this Court by the learned advocate for the petitioner.

With the aforesaid directions, the petition stands disposed of. Direct service is permitted.
