This petition is filed seeking for quashing and setting aside order dated 24.01.2019 in Revision Application No.40-2014 by the Secretary, State by which the order dated 21.02.2014 in Appeal No.12 of 2013 by District Collector was confirmed. The subject matter pertains to cancellation of Fair Price Shop license granted to the petitioner bearing No. R.40 and Agreement No.40.

At the outset, learned advocate for the petitioner states that the petition is part of group which came to be disposed of by common oral order dated 11.07.2019 in Special Civil Application no.6301 of 2019 and other allied matters.

Learned AGP does not dispute this position and hence the Court finds no reason to differ on the view taken in the

aforesaid common oral order dated 11.07.2019 in Special Civil Application no.6301 of 2019.

In view of the aforesaid, on the limited ground as discussed in the aforesaid common oral order, the petition would stand partly allowed and the present case is relegated back to the respondent no.3 - the District Supply Officer, Jamnagar. The District Supply Officer in compliance with the provision of Clause 8 of the Gujarat Essential Commodities (License, Control and Stock Declaration) Act, 1981, shall provide an opportunity of hearing to the petitioner and take a fresh decision on the issue.

With the aforesaid directions the petition stands allowed to the aforesaid extent.
