ORAL ORDER
When the matter is taken up for hearing, at the
outset, learned advocate for the petitioner has
submitted that the petitioner would not like to
invite reasoned order and would like to withdraw the
petition, with a view to enable the petitioner to
deposit 30% amount as ordered by the trial court
within a period of six weeks from today and six
weeks‘ time may also be granted for the purpose of
filing the written statement
To this request, Mr.Zalak B. Pipalia, learned
advocate for the respondent, has no objection.
Considering this, petition is permitted to be
withdrawn. The Court has not expressed any opinion on
merits with regard to the contentions and with the

consent of learned advocates, time to deposit 30%
amount as ordered by the trial court is extended for
a further period of six weeks from today, with an
express observation that petitioner shall abide by
this time schedule of the Court and simultaneously,
the petitioner is also permitted to submit the
written statement within the aforesaid period.
With these observations and directions, present
petition stands disposed of, as not pressed. Notice
is discharged.
