The Criminal Misc. Application No.19009 of 2017 has been preferred by the original accused with the following prayers :

"(A) Your Lordships may be pleased to call for records and proceedings of FIR being C.R. No.I-25/2017 registered with Mahila Police Station, Vadodara and proceedings pursuant thereto and after perusing the same be pleased to quash the impugned FIR, in the interest of justice;

(B) Your Lordships may be pleased to stay the further proceedings in pursuance of impugned FIR being FIR being C.R. No.I-25/2017 registered with Mahila Police Station, Vadodara, pending the admission, hearing and final disposal of this petition;

(C) Your Lordships may be pleased to grant any such other and further reliefs as deemed fit expedient in the interest of justice."

officer higher in rank than respondent no.3 and further be pleased to direct that they shall conduct investigation in a fair and impartial manner into the same and submit report of investigation before this Hon'ble Court and after perusing the same this Hon'ble Court may pass appropriate orders and further be pleased to direct proper and fair investigation may be done.

(AA) Your Lordships may be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction transferring the investigation into the FIR being CR No.I-25 of 2017 registered with the Mahila Police Station, Vadodara city (at Annexure-A hereto) to C.I.D. (State) or to Central Bureau of Investigation (CBI) and further be pleased to direct that they shall conduct the investigation in a fair and impartial manner into the same and submit the report of the investigation before this Hon'ble Court and after perusing the same, this Hon'ble Court may pass appropriate orders and further be pleased to direct proper and fair investigation may be done;

(B) During pendency and final disposal of the present application, Your Lordships may be pleased to direct that the report of investigation into F.I.R. being C.R. No.I-25 of 2017 registered with Mahila Police Station, Vadodara city be produced before this Hon'ble Court (at Annexure-A hereto) and thereafter after perusing the same this Hon'ble Court may pass appropriate orders for transferring the investigation;

(C) Pass any such other and/or further orders that may be thought just and proper, in the facts and circumstances of the present case;"

Let me deal first with the application filed by the accused seeking quashing of the First Information Report.

It appears from the materials on record that the first informant got married with the applicant-accused herein some time in the year 1996 at Vadodara. Within six months of their marriage, they left for the United States of America. In the year 2007, a daughter was born in the wedlock. Thereafter, matrimonial disputes cropped up between the parties. The parties went before the court in the USA and obtained a decree for divorce dated 17th March 2015. According to the case of the first informant, even after the marriage came to be dissolved, the husband persuaded her to maintain social as well as physical relations. Even the relatives of the husband remained in regular contact with the first informant. According to the first informant, she was made to understand by the husband that the marriage had to be dissolved only to please the ego of his mother and sister. The husband, all throughout, gave an impression to the first informant that he loved her and was always ready and willing to take care of her and the daughter. The husband, on several occasions, had promised the first informant that he would remarry her, and on such false promises and representations, she used to indulge in physical relations.

In such circumstances, referred to above, an FIR came to be lodged by the first informant dated 6th July 2017 for the

offences punishable under Sections 376, 377, 506(2) read with Section 114 of the Indian Penal Code, inter alia, stating as under:

"My name is Anita Kumari D/o Anantprasad Dwarkaprasad Pal, aged 45 years, occupation Accountant, residing at B/19, Vraj Darshan Society, Opposite FAG Company, Near ABB, Maneja Road, Vadodara, mobile no. 9712961912

Having appeared personally, I dictate the facts of my complaint that I have been residing with my daughter Arya, aged 9 years, at my parental home since 14/06/2017. Prior to it, I had been residing in America. My marriage was solemnized with Prakashchandra Sharadchandra Shirke, residing at 56, Vivekanand Society, Opposite O.N.G.C., Makarpura Road, Vadodara, at Vithleshwar Vaid Mandir, Karelibaug on 01/07/1996 as per Hindu rites and rituals. After marriage, I started residing with my husband at 56, Vivekanand Society, Opposite O.N.G.C., Makarpura Road, Vadodara. As my husband had been working in America, he went to America after seven months. He used to come to reside with me for five to six months after every one and half to two years. I also started residing at 3848 W, 226, Street, Apartment No. 223, in Torrance, California of America in 2001. The daughter was born to me on 05/10/2007 out of wedlock. My husband suspected my character and installed spy camera. He used to hack my email message, to tap my conversation without my knowledge if I talk with persons of my parental home, and to pressurize me not to maintain relations with persons of my parental home. My husband left me and my daughter and went to my mother-in-law and

sister-in-law's house to reside there in America on 14/08/2012. Thereafter, my husband sent me notice through court for obtaining divorce. He used to visit my house frequently and to have meals with me. He told me that, "I love you very much and further stated that after some time, I would withdraw the case. We would live together as husband and wife." Though he used to pressurize me that, "You do not give reply to the notice. ", I did further procedure in connection with the notice. The proceedings of divorce case continued for five years. During the said period, my husband used to remain in contact with me, to visit my house, to have meals with me and to have sexual intercourse with me against my will. The divorce was granted by American Court on 17/03/2015. After divorce, my husband used to visit my house and to have sexual intercourse with me against my will by giving assurance to me that, "We both will get married again." He also used to sodomize me. I returned to Vadodara from America with my daughter on 19/12/2016. After five days, my husband also returned to Vadodara from America. Meantime, my husband used to call me at his house at at 56, Vivekanand Society, Opposite O.N.G.C., Makarpura Road, Vadodara and therefore, I used to go there. At that time, he used to make me stay at night and to have sexual intercourse with me against my will. When I resisted, he used to threaten me to kill and to show video of our personal moments to his friend. My husband used to take me to my paternal aunt Gulabben Jadav, residing at 7, Gayatri Society, Danteshwar, Vadodara and to pressurize me to stay there for night. At that time, my paternal aunt used to tell me that, "As you both are going to

get married again, there is nothing wrong to stay for night." She also gave me assurance to get me married with Prakash. Despite that, she is getting Prakash married with other girl. She abets my husband. My husband used to have sexual intercourse with me against my will. As my husband gave me assurance of marriage, my family members, my paternal aunt and my husband, being together, performed rituals at Jiji Mata Temple during the festival of Uttarayan in 2017. My husband gave me assurance that, "I will come to Vadodara during the vacation of Arya in America and we will get married." and returned to America on 25/01/2017. Thereafter, I also went to America with my daughter on 30/01/2017 where my husband used to visit my house frequently, to have meals and to have sexual intercourse with me against my will. Thereafter, I have returned to Vadodara with my daughter on 14/06/2017. My husband has also returned to Vadodara one or two days back. I have come to know that he is going to get married with any other girl. Though Prakash Sharadchandra Shirke and I had got divorced, he committed sexual intercourse and sodomy with me by giving assurance that, "We will get married again." I have apprehension of death from Prakash Shirke here and in America. My husband has taken back my ornaments. Holding me mad, he threatens me to forcibly grab my daughter from me. Therefore, it is my lawful complaint against him.

As the facts of my complaint are true and correct as dictated by me, I have put signature after reading and understanding the same."

The applicant - husband is here before this Court with a prayer that the allegations levelled in the FIR are palpably false and the same be quashed.

Mr.Nandish Thackar, the learned counsel appearing for the applicant, vehemently submitted that even if the entire case of the first informant is believed or accepted to be true, none of the ingredients to constitute the offence of rape punishable under Section 376 of the Indian Penal Code are made out. Mr.Thackar would submit that the first informant decided to harass the applicant by filling a false FIR no sooner she learnt that the husband is to get remarried. The first informant wants to prevent the applicant - accused from getting remarried. According to Mr.Thackar, as the entire prosecution is malicious, the FIR be quashed.

On the other hand, this application has been vehemently opposed by Mr.B.B.Naik, the learned senior counsel appearing with Mr.Jeet J.Bhatt, the learned counsel for the first informant. Mr.Naik would submit that the plain reading of the FIR discloses commission of a cognizable offence and the police should be permitted to carry out the investigation in accordance with law. Mr.Naik submitted that the allegation of malafides would not save the situation once the FIR discloses commission of a cognizable offence.

The respondent no.2 - original first informant has filed a detailed affidavit-in-reply explaining all the events that took place between her and the applicant - accused. According to

Mr.Naik, this Court may not exercise its inherent powers at the stage of investigation of the FIR, more particularly, when the allegations are quite serious and the picture is hazy.

Mr.Naik, in support of his submissions, has placed reliance on a recent pronouncement of the Supreme Court in the case of Dineshbhai Chandubhai Patel and others v. State of Gujarat and others, Criminal Appeal No.12 of 2018, decided on 5th January 2018. Mr.Naik placed reliance on the following observations of the Supreme Court :

"27) This Court in State of West Bengal & Ors. vs. Swapan Kumar Guha & Ors. (AIR 1982 SC 949) had the occasion to deal with this issue. Y.V. Chandrachud, the learned Chief Justice speaking for Three Judge Bench laid down the following principle:

“Whether an offence has been disclosed or not must necessarily depend on the facts and circumstances of each particular case. If on a consideration of the relevant materials, the Court is satisfied that an offence is disclosed, the Court will normally not interfere with the investigation into the offence and will generally allow the investigation in the offence to be completed for collecting materials for proving the offence.

The condition precedent to the commencement of investigation under S.157 of the Code is that the F.I.R. must disclose, prima facie, that a cognizable offence has been committed. It is wrong to

suppose that the police have an unfettered discretion to commence investigation under S.157 of the Code. Their right of inquiry is conditioned by the existence of reason to suspect the commission of a cognizable offence and they cannot, reasonably, have reason so to suspect unless the F.I.R., prima facie, discloses the commission of such offence. If that condition is satisfied, the investigation must go on. The Court has then no power to stop the investigation, for to do so would be to trench upon the lawful power of the police to investigate into cognizable offences.”

28) Keeping in view the aforesaid principle of law, which was consistently followed by this Court in later years and on perusing the impugned judgment, we are constrained to observe that the High Court without any justifiable reason devoted 89 pages judgment (see-paper book) to examine the aforesaid question and then came to a conclusion that some part of the FIR in question is bad in law because it does not disclose any cognizable offence against any of the accused persons whereas only a part of the FIR is good which discloses a prima facie case against the accused persons and hence it needs further investigation to that extent in accordance with law.

29) In doing so, the High Court, in our view, virtually decided all the issues arising out of the case like an investigating authority or/and appellate authority decides, by little realizing that it was exercising its inherent jurisdiction under Section 482 of the Code at this stage.

30) The High Court, in our view, failed to see the extent of its jurisdiction, which it possess to exercise while examining the legality of any FIR complaining commission of several cognizable offences by accused persons. In order to examine as to whether the factual contents of the FIR disclose any prima facie cognizable offences or not, the High Court cannot act like an investigating agency and nor can exercise the powers like an appellate Court. The question, in our opinion, was required to be examined keeping in view the contents of the FIR and prima facie material, if any, requiring no proof.

31) At this stage, the High Court could not appreciate the evidence nor could draw its own inferences from the contents of the FIR and the material relied on. It was more so when the material relied on was disputed by the Complainants and visa-se-versa. In such a situation, it becomes the job of the investigating authority at such stage to probe and then of the Court to examine the questions once the charge sheet is filed along with such material as to how far and to what extent reliance can be placed on such material.

¶74

32) In our considered opinion, once the Court finds that the FIR does disclose prima facie commission of any cognizable offence, it should stay its hand and allow the investigating machinery to step in to initiate the probe to unearth the crime in accordance with the procedure prescribed in the Code.

¶75

33) The very fact that the High Court in this case went into

the minutest details in relation to every aspect of the case and devoted 89 pages judgment to quash the FIR in part lead us to draw a conclusion that the High Court had exceeded its powers while exercising its inherent jurisdiction under Section 482 of the Code. We cannot concur with such approach of the High Court.

¶79

34) The inherent powers of the High Court, which are obviously not defined being inherent in its very nature, cannot be stretched to any extent and nor can such powers be equated with the appellate powers of the High Court defined in the Code. The parameters laid down by this Court while exercising inherent powers must always be kept in mind else it would lead to committing the jurisdictional error in deciding the case. Such is the case here.

35) On perusal of the three complaints and the FIR mentioned above, we are of the considered view that the complaint and FIR, do disclose a prima facie commission of various cognizable offences alleged by the complainants against the accused persons and, therefore, the High Court instead of dismissing the application filed by the accused persons in part should have dismissed the application as a whole to uphold the entire FIR in question.

¶81

36) Learned counsel for the accused persons after the arguments were over filed brief note and placed reliance on 2 decisions of this Court reported in (2015) 11 SCC 730 and (2011) 3 SCC 351 in support of their contentions. We have perused the 2 decisions. In our view, both the decisions are

distinguishable on facts, whereas the decision on which we have placed reliance is more on the point. It is for the reason that in the first place, the 2 decisions relied on by the learned counsel for the accused persons were the cases where a complaint was filed in the Court under Section 138 of the Negotiable Instruments Act and in other case under some sections of IPC. It is this complaint which was sought to be quashed by invoking the inherent jurisdiction under Section 482 of the Code. Such is not the case here. Secondly, the decision therefore turned on the facts involved in respective cases.

¶85

37) In the case at hand, the challenge is especially to registration of the FIR. This Court in Swapan Kumar Guha (supra) case examined the exercise of inherent powers of the High Court in the context of a challenge to an FIR. In our view, therefore, the law laid down in Swapan Kumar Guha (supra) is directly applicable to the facts of this case as against the law laid down in the two cited decisions.

¶86

38) In the light of foregoing discussion, it is now necessary that the matter, which is subject matter of FIR in question, needs to be investigated in detail by the investigating authorities in accordance with procedure prescribed in the Code."

¶87

Having heard the learned counsel appearing for the parties and having considered the materials on record, the only question that falls for my consideration is, whether the FIR should be quashed.

On 14th August 2017, a coordinate bench of this Court passed the following order :

"1. The learned advocate for the applicant submitted that the complainant and applicant were married long time back and that after the divorce by bipartite settlement before the Foreign Court, terms and conditions were agreed upon and acted upon.

¶92

1.1. It is further submitted that the allegations made in the FIR are far from truth. However, as the complainant received information that the applicant is likely to get married to another person has triggered the filing of the present FIR.

¶93

1.2. Learned advocate for the applicant has submitted that though the applicant is a resident of USA, at present, he is in India and would make himself available for the investigation.

¶94

2. As against this, learned advocate for the respondent No.2, submitted that since there is allegation, which at this stage would constitute an offence, hence, the FIR may not be quashed, as allegations may require investigation of collecting evidence and quashing of the FIR at the threshold may not be desirable.

¶95

3. Issue, notice returnable on 06.09.2017. Learned APP waives service of notice on behalf of the respondent-State.

In the meanwhile let the investigation proceed, however, no coercive steps against the applicant in connection with the

CR No.I-25 of 2017 registered with Mahila Police Station, Vadodara.

4. The applicant shall file an undertaking before the Court, within a week from today, to the aforesaid effect."

Before the judgment could be pronounced, a further affidavit came to be filed on behalf of the respondent no.2 pointing out that the investigation has been completed and charge-sheet has been filed. In the affidavit, the following averments have been made :

"3. The deponent herein is aware that the above captioned matter has been argued and as per the computer status as on 09.01.2018 matter is kept for CAV. However, due to the recent developments i.e the Charge sheet being filed, this further affidavit is required to be filed.

¶103

4. The deponent herein has just learned that the chargesheet in the case came to be filed on 19.06.2018 by way of Charge-sheet No.11/18 with reference to the FIR in question i.e. CR I.25/2017 filed before the Mahila Police Station, Vadodara city U/sec.376, 377, 506(2) and 114 of the IPC wherein the petitioner is one of the prime accused; and, presented to the 3rd Additional and Civil Judge, JMFC, Vadodara City.

5. The above captioned petition has been filed to quash and set aside the FIR as referred to in the para above. When on 09.01.2018 the matter was conducted before this Hon'ble Court, the Charge Sheet in the case was not filed. As of date the judgment in the case has not been delivered. However, the Charge Sheet, which is not on record and which this

Hon'ble Court is not aware of, has come to be filed just recently and has come to the knowledge of the deponent herein only in the last few days. Therefore it is the duty of the deponent, being the power of attorney of the complainant, to bring this Charge sheet on record before this Hon'ble Court so as to enable this Hon'ble Court to peruse the same and come to a decision accordingly. it goes without saying that the Charge Sheet is a final report u/sec 173 of the Criminal Procedure Code -1973 which implies that investigation has been completed qua the FIR in question. As per Column no.5 of the Charge Sheet annexed hereto an offence u/sec 376, 377,506(2) and 114 of the WC is made out against the present petitioner no.1 as well as another co accused. Therefore, it is the duty of the deponent herein to bring this facts i.e. the recent developments before this Hon'ble Court. Therefore this further affidavit is required to be filed.

6. Therefore in view of the averments made above this Hon'ble Court may kindly peruse the Charge sheet placed on record and thereafter decide the matter in its wise prudence.

7. The deponent herein submits that since the charge sheet is filed i.e. the investigation is over and an offence is made out against the petitioner, this Hon'ble Court may not exercise it powers u/sec 482 of the CRPC -1973 and let the matter stand to trial in the interest of justice. The offences being of a very serious nature of Sec 376, 377 of the IPC and therefore 50. Reliance is placed upon Ghanshyam Sharma v. Surendra Kumar 2014(13) SCC 400 = 2014 (9) Scale 777

and Amanullah v. State of Bihar 2016(6) SCC 699 = AIR 2016 SC 1871 and PADAL VENKATA v. KOWURI REDDY 2011 (12) SCC 437 = AIR 2011 SC (Supp) 819. Also the deponent herein humbly submits that at this stage this Hon'ble Court exercising its extra ordinary jurisdiction should only examined whether allegations made in the FIR and Charge Sheet "prima facie” constitute an offence to make out a case against the accused or not ? Reliance placed upon CBI v. K.M Sharan 2008 (4) SCC 471 = AIR 2008 SC (Supp) 1503. 8. in view of the investigation being completed and the charge sheet being filed this Hon'ble Court be pleased to direct the petitioner to deposit his passport with the concerned court at Vadodara till final disposal of the above captioned application. Since petitioner is having American passport and is a US Citizen, unless he is directed to deposit his passport, there is no way to make sure that he will be available for trial."

Having heard the learned counsel appearing for the parties and having considered the materials on record, the only question that falls for my consideration is, whether the prosecution against the applicant should be quashed.

Having regard to the fact that charge-sheet has been filed, it would be appropriate if the applicant prefers a discharge application before the trial Court. Any discussion on merits may probably cause prejudice to both the sides. In such circumstances, I am disposing of this application without going into the merits of the matter with a liberty to the applicant to prefer a discharge application before the trial Court, if he deems fit.

With the above, this application is disposed of.

¶118

This matter was heard some time in January 2018 and the judgment was kept CAV. Having regard to the nature of the dispute and the relations of the parties, I was quite hopeful that the matter may get resolved amicably. In such circumstances, I did not proceed to decide the matter at the earliest. However, unfortunately, it appears that the parties have not been able to arrive at any amicable settlement. In the mean time, the police completed the investigation and has filed a charge-sheet.
