Following are the directions sought in para 13 of the present

report:-

(A) This Hon’ble Court may be pleased to permit the Official Liquidator to purchaser 10 computers , 01 Laptop & 05 printers for the Office of the Official Liquidator at the total aggregate cost of Rs.4,99,200/- (inclusive all) as per quotation received from M/s. NES Solution.

(B) This Hon’ble Court may be pleased to permit the Official Liquidator to incure the aforesaid total expenditure of Rs.4,99,200/- under head of “Printing & Stationary fund” in the Common Pool Account available with the office of the Official Liquidator.

Para 7 to 12 of the report read as under:-

That, in this connection it is further most respectfully submitted that in order to ensure functioning of the office of the Official Liquidator, certain additions and improvements in infr4astructure and office automation/ computerization are required for optimum use of the available man- power for efficient working of the office of the Official Liquidator. Computerization in the office of the Official Liquidator is necessary so that newly appointed staffs can be utilized properly. The existing officer and company paid staffs of the office of the Official Liquidator can also make p;roper use of advanced computer technology to achieve better efficiency and output with higher speed and more accuracy.

That, the Official Liquidator most respectfully submits that it was decided to purchase total 10 desktop computers, one laptop and 05 printers for the office of the Official Liquidator. Accordingly, sealed quotation to purchase aforesaid items from various vendor were invited and same were placed before the Local Purchaer Committee constituted in Office of the Official Liquidator.

That, in the said meeting it was observed that total 05 quotations were received from vendors namely M/s. Yantra Infotech, M/s. Wiptech Peripherals Ltd., M/s., Kendriya Bhandar & M/s. NES Solution. The same were opened and placed before the members of the purchase committee for perusal. On perusal of the sme it was observed that said vendors have quoted following princes of computers and printers:-

That, after perusing and scrutinizing all quotations, members of the Local Purchase Committee observed that quotation provided by M/s. MES Solution is the lowest amongst quotations received from other vendors.

That, it was being informed by the members of the Local Purchase Committee that at present strength of staffs members is 32 which included officers, Government staffs, company Paid staffs and CS & TCS and amongst which there are total 13 old computers, 12 printers are available in the office of official liquidator. However, presently no laptop and color printer are available in the office. Hence, at present total 20 new computers are required for the office. However it was decided that only 10 Number of competes i.e. 7 computers with Windows 7 and 3 computers with windows 10, 4 black and white printers, 1 color printer and one laptop maybe purchased for the time being. The existing old computer to be repaired/ serviced and to be given to newly recruited CS/TCS & Junior company paid staffs. Accordingly the local purchased committee has unanimously decided to purchase the following items from M/s. NES Solution with following proposed expenditures:-

That, the estimated expenditure in this regard would be around Rs.4,9,200/- as per quotation received from M/s. NES Solution. The Chairman of Local Purchase Committee has recommended that the aforesaid purchase expenditure to be incurred form under head of “Printing & Stationary fund” of the Common Pool Fund maintained by the office of Official Liquidator subject to approval and permission of Hon’ble High Court in this regards. Copy of the Minutes of the Local Purchase Committee dated 30.04.2018 & copy of the quotations received from vendors are annexed hereto and marked as Annexure-”D” (Colly.).

That, the Official Liquidator most respectfully submits that as on date the Official Liquidator is having following amount under head of “Printing & Stationary fund” of the Common Pool Fund maintained by the Office of the Official Liquidator:-

Learned advocate Mr. Saurabh Patel for the Official Liquidator submitted that for the facts and circumstances pointed out in the report, Local Purchase Committee unanimously decided to purchase computers and other equipments, including one laptop, for efficient functioning of the office of the Official Liquidator. He submitted that presently, the Official Liquidator is having sufficient fund as mentioned in para 12 of the report under the head of “Printing and

Stationary fund” of the common pool fund maintained by the Official Liquidator and from such fund, total expenditure of Rs.4,99,200/-, will be required to be spent which the Court may permit for the purpose of purchase of computer, laptop and other equipments.

The Court, having heard learned advocate Mr. Patel and having considered the contents of the report, finds that the prayers sought in the report could be granted. They are accordingly granted. The Report stands disposed of.
