[7] Having heard learned Counsel on both the sides, and after perusing the material on record, we are of the view that there is no merit in these appeals so as to interfere with the common order passed by the learned Single Judge. The competent authority under the provisions of the Gujarat Stamp Act, 1958 after issuing notice and recording reasons has passed orders for collecting differential stamp duty. Though statute provides remedy of appeal before the appellate forum, as the same was not filed within the period of limitation, the appellate authority has rejected the appeal without going into merits of the matter on the ground that the appeal was barred by limitation and there is no provision under the scheme of the Act, 1958 to condone delay. In this regard, useful reference can be made to judgment of Full Bench of this Court in the case of Jayminbhai Navinbhai Doshi v/s. State of Gujarat [2015 (1) GLH 167] , in which a Full Bench of this Court has held that appellate authority has no power to condone delay caused in filing the appeal, in case, the appeals are filed beyond the period of limitation. Further, it is held that this Court also cannot direct to condone delay in exercise of powers under Article 226 of the Constitution of India. The view taken by the Full Bench of this Court supports the reasons recorded by the appellate authority.
