1Learned Counsel Mr. Y.J. Trivedi for the
appellant and Ms.Pooja Acharya, learned advocate for
Mr.R.H.Acharya, jointly requests the Court that the
present Appeal from Order be disposed of, without
going into the merits and that, they will be
satisfied if the Court directs that the Regular Civil
Suit No. 922 of 2005 pending in the Court of learned
Judge, Court No.8, City Civil Court, Ahmedabad, be
directed to be disposed of within a time frame.
2In accordance with the consensus arrived at
between the parties, and without going into the
merits of the matter, the Appeal from Order is

disposed of with a request to the learned trial Court
before which Regular Civil Suit No. 922 of 2005 is
pending to dispose of the said suit preferably within
six months from the date of receipt of copy of this
order.
3It is clarified that, this Court has not
expressed any opinion on merits, and it is kept open
for the respective parties to make their stand on the
question raised in this appeal before the trial
Court. Both the learned counsels for the respective
parties requests that the trial Court may be given
the direction that, if an application is made to
permit the parties to lead their evidence through
Court Commissioner, the application may be considered
by the trial Court accordingly. If such an
application is made, needless to say that the learned
trial Court shall consider such application and
permit the parties to lead the evidence through the
Court Commissioner in order to save time of the
Court. The present Appeal from Order is disposed of,
accordingly.
