The present petition is filed by the petitioners under Articles 14, 226 and 227 of the Constitution of India as well as under the provisions of the Bombay Tenancy and Agricultural Lands Act, 1948 for the prayer inter alia that appropriate writ, order or direction may be issued quashing and setting aside the impugned order passed by the Gujarat Revenue Tribunal in Revision Application No. TEN/BA/380/98 dated 2.7.2012 and also the order passed by the Deputy Collector in Tenancy Appeal No. SR/4/98 dated 29.6.1998 at Annexure-K confirming the order passed in Tenancy Case No. 12022/95 by the Mamlatdar on the grounds stated in the application.

Heard learned Advocate Shri Vikaram J. Thakore for the petitioners and learned AGP Shri Udit Mehta for the Respondents.

In view of the contentions raised and having perused the papers the submissions which have been made pointing out that the appeal as well as revision application have been disposed of only on the ground of delay without considering the same on merits and therefore it ought to have been decided on merits considering the aspect of the condonation of delay. Learned Advocate Shri Thakore submitted that the authority could not have adopted such a technical approach and could have condoned the delay for deciding the application on merits

in accordance with law.

Learned AGP Shri Udit Mehta made a feeble attempt to resist.

As it transpires from the record the issue involved is required to be considered on merits of the matter on examination of relevant material as well as the provisions of Bombay Tenancy and Agricultural Lands Act rather than considering the same on the aspect of delay. The delay of 200 days in taking the steps has also been explained and therefore the authorities could not have adopted such a approach. Even in revision also instead of remanding the Revenue Tribunal has passed the order on the same line which cannot be sustained. The Hon'ble Apex Court as well as the High Court in catena of judicial pronouncements has laid down the broad guidelines with regard to the approach in such matters of condonation of delay and therefore when the party approaches the authority the delay ought to have been considered with pragmatic approach rather than technical approach. It is also well settled that the matter should be decided on merits rather than on technicalities. The Hon'ble Apex Court in a judgment reported in (2010) 6 SCC 786Improvement Trust, Ludhiana v. Ujagar Singh and ors. has made the observations:

“ In the legal arena, an attempt should always be made to allow the matter to be contested on merits rather than to throw it on such technicalities. ”

the interest of justice if the present petition is allowed quashing and setting aside the impugned order at Annexure- O and Annexure-K with further direction to the Deputy Collector to decide the Tenancy Appeal No.4 of 1998 on merits in accordance with law after providing an opportunity of hearing to all concerned preferably within a period of 6 months.

With the aforesaid observations the present petition stands allowed. Rule is made absolute. The order of status quo shall also accordingly remain till the disposal of the appeal before the Deputy Collector.
