Heard Mr. SC Biswas, the learned counsel appearing on behalf of the petitioner. Also heard Mr. BJ Talukdar, the learned Senior Counsel, assisted by Mr. PK Medhi, the learned counsel, who appears on behalf of the respondent No.1 and Ms. B Saikia, the learned counsel, who appears on behalf of the respondent No.2.

The present writ petition has been filed challenging the complaint proceedings being Complaint Case No.ASCW.245/2014, which has been initiated by the respondent No.1 on the basis of the allegations made by the respondent No.2.

Ms. B Saikia, the learned counsel appearing on behalf of the respondent No.2 submits that the matter has already been amicably settled between the respondent No.2 and the petitioner and, therefore, nothing further remains to be adjudicated upon in the present writ petition. Ms. Saikia, the learned counsel further submitted that the said complaint proceedings being Complaint Case No.ASCW.245/2014, therefore, no longer continues.

Mr. PK Medhi, the learned counsel appearing on behalf of the respondent No.1 submits that he has no instructions in that regard.

Considering that the matter between the petitioner and the respondent No.2 has been amicably settled, it is the opinion of this Court that the further continuation of the complaint proceedings being Complaint Case No.ASCW.245/2014 cannot be allowed to be continued which would amount to

the abuse of the process of the Court. Accordingly, the complaint proceedings being Complaint Case No.ASCW.245/2014 stands quashed.

Writ petition, accordingly, stands disposed of.
