Heard Mr. BU Laskar, learned Counsel for the petitioner and Mr. B Talukdar, learned Standing Counsel, Elementary Education.

The petitioner has filed this application under Article 226 of the Constitution of India challenging the order dated 09.06.2020 by which the respondent no.5 was promoted to the post of Headmaster in Chandranathpur M.E. School under Silchar (Sadar), Sub-Division.

It is the case of the petitioner that he was not considered for promotion to the post of Headmaster of the said school although he has made number of representation and he is eligible for the said post. However, when the matter is called up today, the learned Counsel for the petitioner submits that the petitioner retired on 31^st of November, 2025 and the process for his pension is also been initiated. As such, he submits that the instant matter has become infructuous.
