Gauhati High Court (Kardak Ete, J.), order dated 15.05.2026 in WP(C)/2439/2026: A Bachelor of Physiotherapy (BPT) student filed a writ petition seeking a direction to permit him to appear in the Electrotherapy-II 4th Semester midterm examination at Jorhat Medical College and Hospital and to submit his application for the 7th Semester Final Examination scheduled from 26.05.2026. In deference to the Court's order dated 08.05.2026, the learned Standing Counsel, Health and Family Welfare Department, placed on record instructions dated 13.05.2026 that the petitioner had been permitted to appear in the mid term examination on 18.05.2026, his marks/score to be sent to Srimanta Sankardeva University of Health Sciences for declaration of the 4th Semester result, and that on passing all subjects of the 4th Semester he would be eligible for the 7th Semester examination commencing 26.05.2026. Heard Mr. A. Ganguly, learned counsel for the petitioner. Also heard Mr. B. Gogoi, learned Standing counsel, Health and Family Welfare Department.

This writ petition has been filed seeking for a direction to permit the petitioner to appear for the Electrotherapy-II 4^th Semester midterm examination in the Bachelor of Physiotherapy (BPT) at Jorhat Medical College and Hospital and also to permit the petitioner to submit the application to appear in 7^th Semester Final Examination which is scheduled from 26.05.2026.

In deference to the order of this Court dated 08.05.2026, Mr. B. Gogoi, learned Standing counsel, Health and Family Welfare Department, by placing the copy of the instruction dated 13.05.2026, submits that the petitioner has been allowed to appear for the Electrotherapy-II 4^th Semester mid term examination in the Bachelor of Physiotherapy (BPT) which will be held on 18.05.2026 at Jorhat Medical College and Hospital, Jorhat. If the petitioner appears in the examination on 18.05.2026 his marks/score will be sent to the University to declare the result of 4^th Semester and if he passed all the subjects of 4^th Semester, he will be eligible to appear in the 7^th Semester examination, which will commence from 26.05.2026.

Having considered the submissions of the learned counsel for the parties and on perusal of the communication as well as as agreed to by the learned counsel for the parties, this writ petition is closed as no further consideration is required to be made in the present proceedings as the grievance of the

petitioner to allow him to appear in the 4^th Semester examination has been allowed, which is scheduled to be held on 18.05.2026.

Needless to observe that in the event the petitioner appears in the 4^th Semester examination on 18.05.2026, the authorises shall take appropriate steps for declaration of result so as to enable the petitioner to appear for the 7^th Semester, in the event he clears the 4^th Semester examination.
