Heard Mr. S. Walling, learned counsel for the petitioner.

Ms. S. Chang, learned Government Advocate has submitted that as per instructions received by her, out of forty-three petitioners, the cases of thirty-three petitioners have been considered and their services have been regularized. Those petitioners are petitioner nos. 1, 2, 3, 5, 7 to 15, 19 to 21, 23 to 34, 36 to 39 and 41.

It is further submitted that as per her instructions, the petitioner No. 42, namely, Shri Raban. K has superannuated in the meanwhile and as he has rendered service of only 28 years, on the date of his superannuation, he was not entitled for regularization of service under the policy in force. In respect of the remaining nine petitioners, being petitioner nos. 4, 6, 16 to 18, 22, 35, 40 and 43, their cases are in the waitlist and they will be processed as and when their turn comes.

As there is no disagreement at the Bar on the submissions

Page No.# 9/9 made by the learned Government Advocate, insofar as the thirtythree hereinbefore referred regularized petitioners are concerned, as they have got the desired relief, the writ petition has become infructuous in respect of those thirty-three regularized petitioners.

In respect of the petitioner no.42 is concerned, he shall be at liberty to pursue such remedies as he may be so advised to claim any relief. In respect of the other nine petitioners as indicated above as their cases are under consideration and waitlist, they would be at liberty to file representations before the concerned authorities as and when they become entitled to be considered for regularization of service. In respect of the petitioner no.42 and the other nine petitioners as indicated above, the disposal of this writ petition is without prejudice to them.

Accordingly, on satisfaction of the cases of thirty-three regularized petitioners, this matter having become infructuous, is closed with leave granted in respect of petitioner no.42 and other nine petitioners as indicated above.
