The claimants, namely, Ms. F. Begum, Ms. L Begum, Ms. F. Begum and Md. Y. Ali are present before this Court along with Mr. S. Roy, learned counsel.
It has been submitted that the claimant No. 1, Mr. Ansar Ali @ Anachar Ali @ Anchar Ali, has in the meantime expired and therefore, his claim would abate.
It has been submitted that the settlement arrived at between the parties is for an amount of Rs. 4,20,000/-, to be distributed amongst the 4 (four) surviving claimants, who are also the legal heirs of the claimant No. 1 (since deceased). It is also submitted by the claimants that they would be satisfied if the settled amount is deposited into the account of the claimant No. 5, namely, Md. Y. Ali on behalf of all the surviving claimants.
The claimant No. 5 shall furnish the bank details to the insurance company where the settled amount is to be credited.
Accordingly, this MAC Appeal is closed on settlement.
A copy of the settlement shall be kept on record. TCR be returned.
