Mr. J. Biswas, the claimant is present along with Mr. R.K.K. Sinha, learned counsel appearing for the Oriental Insurance Company.

It has been submitted that the claim has been settled for an amount of Rs.34,95,000/-, whereas the amount awarded by the learned Tribunal was Rs.35,29,451/-.

In view of the settlement arrived at between the parties, the appeal can be closed.

¶25

The claimant, Sri Jibon Biswas, shall furnish the bank details of his account where the amount arrived at on settlement, i.e. Rs.34,95,000/-, is to be deposited.

The appellant-Insurance Company has already deposited an amount of Rs.17,64,000/-, which shall be released to the claimant as per procedure. The remaining amount of the settlement arrived at shall be released by the appellantInsurance Company to the bank account of the claimant, for which the claimant shall provide the necessary bank details.

The statutory amount of Rs.25,000/- deposited by the appellant-Insurance Company shall be refunded as per procedure.

The appeal stands closed.

The copy of the settlement shall be kept on record.
