Mr. Rajendra Dutta, representative of Shriram General Insurance Company Limited, is present. Mr. K. Ali, learned counsel, is present for the claimants along with Ms. K. Das, Ms. B. Das and the two minor children who are represented by their mother.
It has been submitted that the present claim has been settled at the original awarded amount of Rs.32,89,000/-. Out of the aforesaid amount, during the pendency of the appeal, the insurer had deposited Rs.16,44,500/before the Registry of this Court, out of which an amount of Rs.6,50,000/- had been withdrawn in the form of fixed deposits and the rest of the amount had been withdrawn and shared amongst the claimants.
On the settlement being arrived at, the insurer shall now pay an amount of Rs.16,44,500/- to the claimants, out of which, on a consensus arrived at between the claimants, an amount of Rs. 1,00,000/- shall be released to the mother of the deceased, namely, Ms. B. Das, while the rest of the amount shall be released in the name of Ms. K. Das, by the insurance company.
The statutory deposit of Rs. 25,000/- made shall be released to the appellant company as per procedure.
The claimants would be at liberty to furnish the appropriate bank details to the insurance company where the payments as aforesaid shall be credited.
A copy of this settlement shall be kept on record.
