16. Ms. Danggen, learned counsel, further submits that PW-13, the cousin brother of PW-5, Ajit Rangmo, stated that it was PW-5 who actually killed the deceased. This statement of PW-13 also casts doubt on the prosecution case. She submits that most of the prosecution witnesses, including PW-12, PW-13, PW-2, PW-3, PW-4, PW-5, and PW-9, opined that the Appellant was a good person and that they did not think he might have killed the deceased. On the contrary, they deposed that the deceased had criminal records and was an aggressive person. She submits that the PW-13 stated in her statement that it was likely that the deceased had enemies and that the Appellant, being of smaller stature compared to the deceased, probably could not have killed him. Therefore, she submits that the prosecution story does not prove the case beyond reasonable doubt and the circumstantial evidence also does not point to anything against the Appellant in the present case. Hence, she submits that the prosecution has failed to prove it’s case and therefore, the Judgment and Order dated 30.04.2021, passed by the learned District and Sessions Judge, Bomdila,
